This Developer Agreement (the “Agreement”) is between you and HOOP Technology Sdn. Bhd. and applies when you apply for or hold a developer role on HOOP — publishing games, using the developer center, HOOP hosting, or the developer APIs (the “Developer Program”). It supplements the Terms of Use, which continue to apply to you as a user. By applying to become a developer or by submitting a game, you accept this Agreement.
1. Becoming a developer
A developer is a HOOP user with an approved developer role — not a separate account. Applications are reviewed and may be declined or revoked at our discretion. You must be at least 18 years old (or the age of majority where you live) to receive payouts.
2. Your games
You own your game. You retain all rights in the games and assets you create.
License to HOOP. You grant HOOP a worldwide, exclusive, perpetual, irrevocable, royalty-free and sub-licensable license to host, operate, distribute, display, promote, adapt and modify your game, and to monetise it (in-game purchases and advertising), within the HOOP platform and its successor platforms. “Exclusive” means that while your game is on HOOP you will not publish the same game, or a substantially similar version of it, on another social or gaming platform without our written consent.
Continuity. This license survives the end of your developer role: if you stop developing, leave the program, or your account is terminated, HOOP may continue to operate, maintain and monetise the games already published, and you remain entitled to your revenue share on them under section 6.
You warrant that your game is your original work or properly licensed, and does not infringe anyone's rights or violate any law.
3. Content standards and review
Every game is reviewed before publication and may be re-reviewed at any time. Games must comply with the Terms of Use (section 5) and the Community Guidelines. In addition, games must not:
contain hidden functionality, load undisclosed remote code, or change behaviour materially after review;
mislead players about odds, rewards, or purchases; real-money gambling is prohibited;
attempt to break out of the game sandbox, probe HOOP systems, or interfere with other games.
4. THE SHADOW-ID PRIVACY RULE
Players are presented to your game only as an anonymised, per-game shadow ID with aggregated gameplay data. You must not attempt to identify, fingerprint, track, or contact players outside HOOP; must not collect personal data inside your game (no login walls, no email/phone prompts, no third-party analytics or advertising SDKs); and must not transmit player data off HOOP infrastructure. Breach of this section is grounds for immediate takedown and termination, and forfeiture of unpaid revenue share.
5. Hosting and custom domains
If you use HOOP hosting, you are responsible for the content of every deploy, and rollbacks/takedowns may be applied by HOOP for policy or security reasons. If you bind a custom domain, you warrant that you control it lawfully; TLS certificates are issued for service operation only, and the binding may be removed if the domain serves content that violates this Agreement.
6. Revenue share and payouts
Standard split — 20%. You receive 20% of net revenue attributable to your game, on both streams: (a) in-game purchases settled in HOOP's virtual currency (1 green energy is referenced at USD $0.01 for accounting), and (b) advertising revenue, allocated across games in proportion to completed ad views. “Net revenue” is what HOOP actually receives after app-store commissions (Apple currently takes 30% of in-app purchases), payment processing, refunds, chargebacks, and taxes.
Negotiated terms. HOOP and a developer may agree in writing to a different (including higher) share for specific games or catalogues. A signed agreement prevails over this section.
Changes. We may change the standard split prospectively. Material changes are notified in the developer center before they take effect, and never apply retroactively to earnings already recorded. If you do not accept a new split, you may unpublish your games and request payout of your existing balance.
Payouts are request-based from the developer center, subject to identity verification, minimum thresholds, and applicable taxes (which are your responsibility).
Clawback. Earnings from fraud, self-dealing, or manipulated transactions are void and may be deducted from future payouts.
7. Takedown, suspension, termination
We may remove a game, suspend developer features, or terminate this Agreement if you breach it, create legal or security risk, or harm players. Where practical we will tell you why and give you a chance to fix it. You may unpublish your games and leave the program at any time; sections 2 (license during publication), 4, 6 (clawback), 8, and 9 survive as applicable.
8. Disclaimer and indemnity
The Developer Program is provided “as is”; we do not guarantee revenue, placement, or uptime. You will indemnify HOOP against claims arising from your game or your breach of this Agreement. The limitation of liability in the Terms of Use applies to this Agreement.
9. General
This Agreement is governed by the laws of Malaysia. We may update it; material changes will be notified in the developer center or by message, and continuing to use the Developer Program after the effective date means you accept the update.
